Tax number: 32341856-2-42, bank account number: K&H Bank HU49 1040 1914 5052 7085 8354 1005 IBAN: IBAN: HU49 1040 1914 5052 7085 8354 1005 SWIFT: OKHBHUHB, email: info@homeartgallery.com) –, the customer must accept all provisions set forth in these General Terms and Conditions as well as the Data Protection Regulations pertaining to the entire homepage of Home Art Gallery Kft.
To accept these conditions, the customer must click on the “Accept General Terms and Conditions and Data Protection Regulations” buttons. The vendor and the customer of the Webshop of Home Art Gallery kft.. shall enter into an electronic purchase contract, which shall become effective upon acceptance of the General Terms and Conditions and the Data Protection Regulations. The data provided shall be electronically retained by the vendor.
Home Art Gallery Kft. retains the right to cancel the purchase contract if its current inventory does not permit the execution of the specific purchase intention. If the ordered product/s is/are in stock, the delivery time is 5-15 days depending on the destination country.
In the Webshop of Home Art Gallery Kft. payments can be made by advance bank transfer and electronic payment. The electronic payment system is provided by Mastercard, K&H Bank (KBC Bank) and PayPal for our customers. In the case of electronic payment, the purchase price will be debited from the customer’s bank account.
The webshop immediately sends a message to the buyer regarding the success or failure of the transaction. If the transaction was successful, but the buyer did not register in the Home Art Gallery webshop system, a staff member of the seller will contact the buyer within 24 hours for further coordination.
If the payment method is advance payment and the amount does not arrive at the Home Art Gallery Kft.'s bank account within 10 working days, the order will be cancelled.
The courier service undertakes to deliver the undamaged package
By accepting the General Terms and Conditions, the customer declares that they know the import regulations of the destination country and the addressee bears all costs when entering the package to the destination country.
The VAT content of the invoice depends on the laws of the country receiving the goods.
Way of delivery:
The purchased product(s) delivered to the specific address by a courier service. The shipping address and the billing address may be different.
Home Art Gallery Kft. primarily uses FedEx as its default courier for all shipments. If the buyer prefers a different courier, they must specify their choice explicitly at the time of order placement. In such cases, Home Art Gallery Kft. cannot guarantee the standard delivery times previously mentioned and will require further consultation with the buyer to discuss the specific conditions and potential adjustments to the shipping timeline.
Proof of Condition Upon Receipt for High-Value Purchases: For orders valued at EUR 300, USD 300, or 100,000 HUF and above, as a protective measure against potential discrepancies, we require buyers to video record the process of unpacking the received item from our secured packaging. Home Art Gallery Kft. uses a distinctive tape to ensure the parcel remains intact during the shipping process. The buyer has 10 days from the date of reporting the claim to provide such video evidence. This video will serve as evidence to verify that the buyer received the item in the same condition in which it was shipped. In the unfortunate event that an item is reported as damaged during delivery, claims and returns will only be accepted if the video unequivocally demonstrates that the damage occurred during the delivery process and not subsequent to the item being unpacked by the buyer. Absence of such a video or any discrepancies in the unpacking process may invalidate a claim.

In accordance with the prevailing legislation, the vendor undertakes a warranty and guarantee commitment. Upon receipt, the customer shall ascertain whether the package is undamaged. If the package is damaged, a record shall be drawn up, and in case of a Hungarian address the package shall be returned to 1163 Budapest Kicsi utca 10.
In this case the vendor shall repay the purchase price already paid by the customer immediately, but no later than within 14 days of the return of the product(s), without any obligation to pay interest. Home Art Gallery Kft. can hold back the full amount paid by the customer until the customer returns the product(s) or undoubtedly proves the return of the product(s). The direct cost of returning the product(s) is borne by the customer.
Please make sure that you accept undamaged packages only. In every case, the courier will make you sign a proof of receipt in which you acknowledge that the package is undamaged at the time of receipt. If you experience any problem, please request that a record should be drawn up.
The use of all personal information collected by the vendor shall be governed by the general data protection regulations. Personal information shall be used in accordance with the effective provisions of the Data Protection Act. The protection of your personal data is a priority for Home Art Gallery Kft. and its partners. The collection and processing of the required identifying personal data when using our website complies with the Hungarian data protection regulations in force (Act CXII / 2011).
Vendor shall store customers’ data solely for the purpose of fulfilling orders and as a subsequent proof of purchasing circumstances, for providing the newsletter requested by the customer, and for marketing purposes.
Transfer of data to third parties is strictly limited to the cases where the use of such data by a subcontractor third party is essential for the fulfilment of the purchase order and the execution of the subcontractor’s subtasks associated with the purchase. Even in those cases no data may be transferred other than those essential for the execution of the specific subtask.
Moreover, data may be disclosed in response to official inquiries based on a legislative provision when the vendor is subject to mandatory data reporting. Likewise, any subcontractors engaged shall be legally bound by the provisions of the Data Protection Act.
Home Art Gallery Kft. does not submit itself to the Act XLVII 2§ i) / 2008 of Code of Conduct.
Vendor may not be held liable for any errors, inconveniences, direct or indirect damages inflicted by the technical (hardware, software) or communications (internet) infrastructure used in the course of connecting to the Webshop of Home Art Gallery Kft., regardless of whether they arise from the ordinary or extraordinary operations of the server or the client side.
Vendor retains the right to modify, without cause, any information located in the Webshop of Home Art Gallery Kft. (including these General Terms and Conditions), thus, for instance, including the products, the product descriptions or the regular or sales prices of the products. Since all information relating to the Webshop of Home Art Gallery Kft. is publicly available, the vendor may not be held liable for any errors, inconveniences, direct or indirect damages arising from a lack of knowledge regarding the prevailing information.

In any other cases not controlled in these General Terms and Conditions shall be applied the relevant provisions of the prevailing Hungarian legislation between vendor and customer when purchasing from the Webshop. In case of a dispute, depending on the value of the object in dispute, shall have the Pesti Központi Kerületi Bíróság and the Fővárosi Törvényszék (Veszprém Regional Court) exclusive jurisdiction; vendor and customer stipulate the exclusive jurisdiction of these courts.
